Joe has the right idea, however, let us not forget that
boards of pharmacy are not in place to protect pharmacist. They were
established and live with the idea of protecting the public from
pharmacist. So, if we depend on boards of pharmacies to protect us
from the federal government, we will be waiting for a long time.
Also, keep in mind that the local, state boards may not have
the savvy or inclination to mire themselves in the internet/on-line
quagmire. In this case they may welcome or even invite the federal
govt. to make and enforce the rules.
I share Joe's distrust of federal intrusion. The sad part is
that the internet/on-line pharmacy may be operating in its home state
with a cozy relationship with the board who sees nothing wrong with
what they are doing. Look at mail-order houses. No problem there.
If this is the case then having another state block "their"
pharmacist business may be viewed as an intrusion on "their" rights.
As far as federal control of practice, they are in pretty
deep now. The various federal agencies can exert a rather high
velocity of problems for any local entity that they view as "doing
wrong." The FDA, DEA, HCFA, OSCIA, and others call the shots for a
lot of what we do.
I was in retail for a long time. I battled physician
sampling, mail order, substitution, generic look/sound alike and
physician dispensing. None of them put me out of business. What got
me was business deals cut between major employers and major chains
with the insurance companies writing the contracts. On-line looks
like another deal that will cause us all to work a little harder.
When its over, its just change.
